Pennsylvania Tenant Rights & Protections

Pennsylvania Human Relations Act (43 P.S. 951 et seq.) prohibits housing discrimination and is enforced by the Pennsylvania Human Relations Commission (FHAP agency). The Landlord and Tenant Act (68 P.S. 250.101 et seq.) governs rental housing. Security deposits are capped at 2 months' rent in the first year, then 1 month's rent thereafter; must be returned within 30 days. Month-to-month tenancies require 30 days' notice (15 days for leases of 1 year or less). Retaliatory eviction is prohibited; landlords cannot evict or raise rent in response to a tenant reporting code violations or exercising legal rights.
